This section deals with conditions relating to the sale of products by Flowers in Love

There are currently two main ways to purchase from Flowers in Love - via the Papal system (safe and secure online payments - best for international orders) or for Australian residents, there is a printable online form available at www.flowersinlove.com/faq.html which can be printed off then paid by bank deposit (contact me for bank details); cash (local Geraldton residents only); or money order (made out to 'Flowers in Love'). No personal cheques are accepted.
LAYBY: Flowers in Love is happy to provide a layby service for orders over AUD$150.00. A fee of 30% of the value of goods applies when placing a layby; and this fee also applies to the cancellation of a layby. Unless other arrangements have been made (eg Christmas laybys - see below) layby is for a period of six weeks only. Due to the custom nature of Flowers in Love's goods, refunds are not given if you simply change your mind; however refunds are happily given if goods are found to be faulty. Flowers in Love will contact you about your layby by email. It is your responsibility to ensure our emails are not filtered from your e-mail inbox. Emails will be sent from flowersinlove@y7mail.com - please ensure this e-mail address is in your e-mail white list. All Payment schedules and order histories can be requested from Flowers in Love and can be sent to you.
CHRISTMAS LAYBY'S - If you wish to order over AU$100.00 of jewellery as Christmas gifts, you are invited to take advantage of Flowers in Love's extended layby. Orders placed between August 15 and December 15 2010 can be placed on layby under the standard terms (see above) with a 30% non-refundable deposit (no layby fee); final payment is not required until:
* November 20th (international orders)
* December 15th (australian postal orders)
* December 22nd (local pick up)
All orders to be posted must be paid in full before I can post them, so please ensure you have calculated postage time and paid in full in plenty of time for the gifts to be delivered. I am not responsible for late postage of orders that were not paid in time for early delivery. Christmas layby form can be downloaded below. All prices stated on the web site are in Australian Dollars (AUD) and do NOT include GST - Flowers in Love is currently not required to register for (or charge) GST.
When you visit flowersinlove.com, use our contact form or sending us an e-mail you are communicating with us electronically (sending us an electronic communication). By doing so you are consent to receive electronic communications from us through e-mail and website postings. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
There are no minimum orders.
We have standard postage charge of: $10.00 for all Australian orders, $18.00 for all international orders.
Most orders are custom made to your requirements. Although we try to keep components in stock, sometimes items may need to be ordered in to complete your order. Most orders are posted within 4-6 weeks - if you require a speedy delivery please contact me to find out which colours are available for immediate use, and your order will be completed and posted as soon as possible. If your order will not be posted within the given time frame, you will be contacted directly to discuss options.
If you have a complaint or suggestion about our service please contact us via our contact form and we will do our utmost to reply and resolve the issue as soon as possible.
We will keep you informed as to the steps being taken to resolve your issue/s.
Most of the jewellery & beads on my site is handmade which may result in:
> Slight differences in product shapes and sizes
> Slight differences in colour
Please note that each item of jewellery is individually handmade from the finest quality precious metals and beads. Flowers in Love continually applies their best endeavours to ensure maximum closeness between the photo used in both online and offline acatlogues, and the ordered item, however it is impossible to guarantee exactness in colour and measurement between item pictured and the newly created piece. These slight differences are not to be considered as faults, as the beauty of handmade jewellery is that each piece may differ slightly from the one before it.
As monitors are all calibrated in a slightly different way colour tonal differences of our products will occur; this is unavoidable.
We reserve the right to make changes to our website, policies, and these Conditions of Sale at any time. You will be subject to the policies and Conditions of Conditions of Sale in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
These conditions are governed by and construed in accordance with the laws of Australia.
